Terms of Service

These terms explain what we are, what we do, and your rights when you buy from us. Please read Section 2 (what we are) and Section 6 (refunds) in particular.

Important: Section 7 contains a binding arbitration provision and a waiver of jury trials and class actions for disputes governed by U.S. law. If you are a consumer in the EU or UK, your mandatory local consumer rights still apply — see Section 6.

1. Acceptance of these terms

Passage Card is a trading name of Passage Travel Services LLC, a limited liability company registered in New Mexico, USA, with a mailing address at 5203 Juan Tabo Blvd NE, Albuquerque, NM 87111. "We", "us" and "our" mean that company; "you" means the person purchasing our service.

By accessing, browsing, or purchasing through our website, you agree to these Terms, our Privacy Policy and our Refund Policy (together, the "Agreements"). If you do not agree, do not use the service. You confirm you are old enough to form a binding contract, or are acting with a parent or guardian's permission.

2. What we are — and what we are not

We are not a government body. We are an independent private company. We are not affiliated with, endorsed by, appointed by, or acting on behalf of the Thai Immigration Bureau, the Government of Thailand, or any other government or public authority.

The Thailand Digital Arrival Card is issued free of charge by the Thai Immigration Bureau at tdac.immigration.go.th. You may apply there yourself at no cost. Our fee is charged solely for preparing, checking and filing the application on your behalf.

Limited authorization. By purchasing, you appoint us as your limited agent for the specific purpose of preparing, checking and submitting your travel-document application to the relevant authority, accepting any government terms required to complete it, and receiving the resulting confirmation on your behalf. This creates no partnership, employment or other relationship.

No guarantee of approval. Whether a document is issued is decided solely by the government authority. We cannot and do not guarantee approval, and our processing times are estimates, not guaranteed delivery dates. We are not responsible for delays caused by the authority, demand, or system outages on their side.

3. What we do, and your responsibilities

You are buying a preparation and filing service: we collect your information through a guided application, have a person review it against the passport details and travel dates you provide, raise any inconsistencies with you before submitting, monitor the filing window, submit within it at the speed you chose, and send you the resulting confirmation.

You are responsible for giving us information that is accurate and matches your passport exactly, for holding a valid passport and meeting entry requirements, for telling us promptly of any change, and for checking the confirmation email we send after purchase. We check your information for consistency and obvious errors, but we cannot verify it against records we do not hold. If you give us incorrect information and we file it as given, we are not responsible for the outcome, though we will help you correct it — see Section 6.

4. Timing and filing windows

Most travel documents can only be submitted during a defined period before arrival. For the Thailand Digital Arrival Card this is 72 hours before your arrival date; earlier submissions are rejected by the authority. This is the authority's rule, not ours, and no service can submit outside it.

You may buy from us at any time, including months ahead. We hold your details and submit when the window opens. The service speeds below are measured from when the window opens (or from purchase if it is already open), not from when you pay:

These are commitments about when we submit. Speeds move you up our review queue; they do not change how quickly the government processes the submission, and are not a guarantee of approval.

5. Fees and the two-fee structure

Two kinds of charge can apply, and we always show them separately:

The Thailand Digital Arrival Card has no government fee. For it, our service fee is the only charge. No option is pre-selected, and we add nothing after you have seen your total.

6. Refunds and cancellation

Your purchase is subject to our Refund Policy, incorporated here by reference. In summary:

Before we submit, you may cancel at any time for a full refund of our service fee, no reason required. Once we have submitted, our service has been fully performed and the fee is non-refundable, except where a failure was ours (see the Refund Policy).

EU / UK consumers. You normally have a 14-day right to withdraw from a distance contract. Because our service is often performed inside a short window that may fall within those 14 days, you ask us to begin the service when you purchase, and you understand the right of withdrawal ends once the service has been fully performed (i.e. once we submit), consistent with Article 16(a) of Directive 2011/83/EU and equivalent UK law. Your cancellation rights under our Refund Policy are more generous than this minimum, since we refund in full any time before we submit.

7. Dispute resolution (U.S. arbitration)

For disputes governed by U.S. law, you and we agree that any dispute arising out of the service or these Terms will be resolved by binding individual arbitration before a single arbitrator under the American Arbitration Association's Commercial Arbitration Rules, seated in Bernalillo County, New Mexico, rather than in court, and each party waives any right to a jury trial. Class, collective and representative actions are waived.

Either party may still bring an individual claim in small-claims court, or seek injunctive relief for intellectual-property or service-misuse matters. You may opt out of this arbitration agreement by writing to us within 30 days of first accepting these Terms. Before starting arbitration, you agree to send us a written notice of dispute and allow 30 days to resolve it.

EU / UK consumers keep their mandatory local rights, including access to their own courts and to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr; nothing here removes protections that cannot lawfully be waived.

8. Payment disputes and chargebacks

Billing descriptor. Charges appear on your statement as PASSAGECARD. Please recognise this and don't report the charge as unrecognised based on the name alone.

Contact us first. Before starting a chargeback, please contact support@passagecard.com and allow us 7 business days to resolve it. We would far rather refund you directly and quickly — a chargeback takes months, and we can usually settle it in days.

If you start a chargeback for a charge that was valid, we may contest it by submitting evidence of the service delivered, and we may decline to serve you again. If you receive both a refund and a successful chargeback for the same charge, you agree to return the duplicate amount.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including missed flights, cancelled bookings, or losses caused by government decisions or delays. Our total liability for any claim is limited to the greater of the fee you paid us for the service in question, or USD 100.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; where that is so, our liability is limited to the fullest extent the law allows.

10. Right to refuse or end service

We may refuse or end service, and cancel a pending order, where information provided appears forged or stolen, where we reasonably suspect illegal use, where a customer is abusive to our staff, where sanctions or export rules require it, or where a customer repeatedly fails to provide what is needed. Where we end a service you have paid for but not received, we refund it in line with our Refund Policy.

11. Your data

We process personal data, including passport details, to deliver this service. How we do that, how long we keep it and your rights are set out in our Privacy Policy, which forms part of these Terms. Delivering the service necessarily means transmitting your details to the relevant government authority — for Thailand, the Thai Immigration Bureau. That transfer is the service.

12. Events beyond our control

We are not liable for failure to perform caused by events beyond our reasonable control, including government actions, border closures, changes in entry rules, pandemics, or failures of third-party government systems.

13. General

If any provision is found unenforceable, it is limited or removed only to the minimum extent necessary and the rest stays in force. These Terms are drafted in English; the English version governs. The version that applies to your order is the one in force when you placed it.
